Wills and Probate Lawyers - FAQs

  • What does a Probate Lawyer do?

A probate lawyer is a legal professional who will help you through the difficult process of settling a loved one’s estate after they pass away. At our Brisbane-based probate law firm, we boast an experienced team of will and probate lawyers ready to provide advice and specialised services.

A will and probate lawyer can help you apply to the Supreme Court for Probate, a term referring to the legal process of dealing with a person’s estate after they have passed away. This process includes validating the will, managing the estate, paying debts, and distributing assets.

We know this process can yield considerable stress. This is where our highly skilled team of probate lawyers can help you lift the burden so that you can honour the deceased’s wishes and complete your probate application.

  • What is the Fixed Fee for Probate in QLD?

If you’re ready to work with the probate lawyers Brisbane trusts, our dedicated team at Queensland Probate is ready to assist with probate and estate administration. We offer a low fixed fee of $ 2,286.50 AUD (or $1,803.20 if you have a concession card) to ease the pressure.

Our lawyers' probate services include advertising, supreme court filing fees, and the completion of your Grant of Probate application. If there are any additional problems with the probate process, additional fees will apply. Rest assured, our wills and probate lawyers will work with you to ensure the best possible outcome.

  • How long does it take for Probate to be granted in QLD?

After your probate lawyer has lodged your application, it should take the Supreme Court between 4-8 weeks to approve the Grant of Probate. This, of course, depends on any complications that arise and may take longer during peak periods.

The complexity of the estate and any disputes can extend the timeline, which is only going to add to your stress in an already difficult situation. This is where our Brisbane-based law firm can provide relief, delivering legal services and expert legal advice.

Our team of probate lawyers in Brisbane can help you manage the legal intricacies and estate issues that can arise when managing a deceased estate.

  • What is the difference between a Probate Lawyer and an Estate Lawyer?

While probate lawyers and estate lawyers both work in similar areas of estate law, they aren’t entirely the same. In fact, there are three types of lawyers who work within estate law. These are probate lawyers, estate lawyers, and probate litigation lawyers.

    Probate Lawyers

Probate lawyers handle the probate process after a person passes away. This includes guiding clients through the complex and emotional process of settling a deceased estate and ensuring the deceased person's assets are properly distributed according to the will or state laws if no will exists.

    Estate Lawyers

Estate lawyers, on the other hand, will help clients set up and create an estate plan that ensures their wishes are honoured after they pass away. Our estates’ lawyers will help clients organise their wills and estates, navigate tax matters, and provide advice to help avoid the risk of any potential estate disputes and legal issues.

    Probate Litigation Lawyers

Probate litigation lawyers deal with complex estate litigation and will disputes that arise from estate administration. These legal experts play a crucial role in ensuring that the decedent's wishes are honoured and that beneficiaries receive their rightful inheritance.

From contesting wills and trusts to handling disputes among heirs, probate litigation lawyers meticulously analyse documents, gather evidence, and represent their clients in court.

  • Do all wills need to go through Probate in QLD?

Not all wills need to go through probate in Queensland, but there are circumstances where probate becomes necessary.

Probate is required when dealing with estate assets worth substantial value. In general, probate is necessary when the assets are owned solely by the deceased party. This includes real estate and other valuable assets.

If the estate is small or consists mostly of joint assets or assets with designated beneficiaries, probate may not be necessary. To help clients navigate through the probate and estate administration process, we will pair you with a probate lawyer Brisbane locals trust to help you find the right outcome.
